These Terms of Service govern your access to and use of the Dead Saints™ website, products, and services. Throughout these Terms, “Dead Saints™,” “we,” “us,” and “our” refer to Dead Saints™ Clothing.

By visiting our website, creating an account, or purchasing from us, you agree to these Terms and any additional policies referenced here. If you do not agree, do not use the website or place an order.

1. ONLINE STORE TERMS

You must be at least the age of majority in your state or jurisdiction to use this website or have permission from a parent or legal guardian.

You may not use our website or products for unlawful or unauthorized purposes. You may not introduce malicious code, interfere with the website’s operation, attempt to gain unauthorized access, or violate the rights of Dead Saints™ or any third party.

A violation of these Terms may result in suspension or termination of your access.

2. PRODUCTS AND AVAILABILITY

Our products may be available exclusively online and in limited quantities. Product availability, colors, sizes, designs, and pricing may change without notice.

We make reasonable efforts to display product colors, images, embroidery, prints, and details accurately. However, appearance may vary depending on your screen, lighting, garment size, production process, or natural manufacturing variations.

We reserve the right to:

  • Limit product quantities

  • Discontinue products or collections

  • Restrict sales to certain individuals, regions, or jurisdictions

  • Correct pricing or product-information errors

  • Refuse or cancel an order when reasonably necessary

3. ORDERS

Submitting an order does not guarantee acceptance. An order is accepted when we send confirmation that it has entered processing or fulfillment.

We may refuse or cancel an order because of:

  • Product unavailability

  • Pricing or listing errors

  • Suspected fraud or unauthorized payment activity

  • Incorrect billing or shipping information

  • Violation of these Terms

  • Quantity or geographic restrictions

If we cancel an order after payment has been collected, we will issue a refund to the original payment method.

Because orders may enter production quickly, cancellation or modification requests are not guaranteed.

4. PRICING AND PAYMENT

All prices are displayed in U.S. dollars unless stated otherwise. Prices, promotions, discounts, and shipping offers may change without notice.

You agree to provide current, complete, and accurate billing, shipping, payment, and contact information. You authorize us and our payment providers to charge the payment method submitted for your order, including applicable taxes and shipping charges.

Discount codes cannot be combined unless expressly stated. Promotions have no cash value and may be modified or ended at any time, subject to applicable law.

5. SHIPPING AND DELIVERY

Processing and delivery estimates are not guarantees. Delays may occur because of production, carrier disruptions, weather, incorrect addresses, customs, or circumstances outside our reasonable control.

Customers are responsible for entering a complete and accurate shipping address. Additional charges caused by an incorrect or incomplete address may be the customer’s responsibility.

Shipping and delivery are also governed by our Shipping Policy.

6. RETURNS AND REFUNDS

Returns, exchanges, cancellations, damaged items, and refunds are governed by our Return & Refund Policy. That policy is incorporated into these Terms by reference.

7. INTELLECTUAL PROPERTY

All content appearing on the Dead Saints™ website—including trademarks, logos, symbols, garment artwork, graphics, photographs, videos, product names, written content, website design, and other creative materials—is owned by or licensed to Dead Saints™ and protected by applicable intellectual-property laws.

You may not copy, reproduce, modify, distribute, sell, license, publish, display, create derivative works from, or commercially exploit our content without prior written permission.

Purchasing a product does not transfer ownership of the artwork, trademarks, or other intellectual property appearing on that product.

“Dead Saints™,” its wordmarks, monograms, symbols, and related branding may not be used in a way that suggests affiliation, sponsorship, or approval without written authorization.

8. CUSTOMER CONTENT AND REVIEWS

If you submit a review, photograph, comment, testimonial, suggestion, or other content, you confirm that:

  • You own or have permission to submit it

  • It does not violate another person’s rights

  • It is not unlawful, fraudulent, threatening, defamatory, obscene, or malicious

  • It does not contain malware or misleading information

You grant Dead Saints™ a nonexclusive, worldwide, royalty-free license to use, reproduce, edit, publish, display, and share submitted content for operating and promoting the brand, unless prohibited by law.

We may remove customer content that violates these Terms. We are not obligated to publish every submission.

9. PROHIBITED USES

You may not use the website or its content to:

  • Violate any law or regulation

  • Infringe intellectual-property or privacy rights

  • Harass, threaten, abuse, or discriminate against others

  • Submit false or misleading information

  • Transmit viruses, malware, or harmful code

  • Collect personal information without authorization

  • Spam, phish, scrape, crawl, or interfere with website security

  • Circumvent purchasing limits or fraud-prevention measures

  • Resell products through deceptive or unauthorized practices

  • Impersonate Dead Saints™ or misrepresent an affiliation with us

We may terminate access for prohibited activity.

Our store is hosted by Shopify, and we may use third-party providers for payments, fulfillment, analytics, shipping, marketing, and other services.

Third-party websites, applications, and services may have separate terms and privacy practices. Dead Saints™ is not responsible for third-party content, availability, policies, or actions except where responsibility cannot legally be excluded.

Your use of third-party services is at your own discretion and may be subject to additional terms.

11. PERSONAL INFORMATION

Personal information submitted through the website is governed by our Privacy Policy. By using the website, you acknowledge that information may be processed by Shopify and other providers necessary to operate the store, process payments, fulfill orders, prevent fraud, and deliver services.

12. ERRORS AND INACCURACIES

The website may occasionally contain typographical errors, inaccurate descriptions, incorrect pricing, unavailable products, or incomplete information.

We may correct errors, update information, or cancel affected orders at any time. If an order is canceled after payment, we will refund the affected amount to the original payment method.

13. DISCLAIMER OF WARRANTIES

We aim to keep the website accurate, secure, and available, but we cannot guarantee uninterrupted or error-free operation.

To the fullest extent permitted by law, the website and its content are provided “as is” and “as available,” without warranties not expressly stated by us. This section does not limit any warranty or consumer right that cannot legally be excluded.

14. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Dead Saints™ will not be liable for indirect, incidental, special, punitive, or consequential damages arising from your use of the website or purchase of our products.

Our total liability for a claim relating to a specific purchase will not exceed the amount you paid for the product giving rise to that claim, except where a different limitation is required by law.

Nothing in these Terms excludes liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or other nonwaivable obligations.

15. INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify and hold Dead Saints™ and its service providers harmless from third-party claims, losses, or reasonable expenses arising from your unlawful misuse of the website, violation of these Terms, or infringement of another party’s rights.

This obligation does not apply to claims caused by our own unlawful conduct.

16. TERMINATION

You may stop using the website at any time.

We may suspend or terminate access if we reasonably believe you violated these Terms, engaged in fraud, threatened website security, or misused our services.

Obligations and liabilities arising before termination will remain enforceable.

17. SEVERABILITY

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in effect.

18. NO WAIVER

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

These Terms and the policies referenced within them constitute the entire agreement between you and Dead Saints™ regarding use of the website and purchases from us.

20. GOVERNING LAW

These Terms are governed by the laws of the State of Ohio and applicable federal laws of the United States, without regard to conflict-of-law principles.

Nothing in this section prevents a consumer from exercising rights that cannot legally be waived under the laws of their jurisdiction.

21. CHANGES TO THESE TERMS

We may update these Terms to reflect changes in our business, services, or legal obligations. Updated Terms become effective when posted unless otherwise stated.

Your continued use of the website after an update constitutes acceptance of the revised Terms, to the extent permitted by law.
